General Terms and Conditions
1. General Information, Contract Conclusion
The operator of the website www.exclusivebottle.ch is Zürcher Handelskontor GmbH, CH-8712 Stäfa, hereinafter referred to as "Z-HK GmbH". The online ordering of products is based on the following General Terms and Conditions (GTC) for online transactions. By submitting the online order, the customer accepts the present GTC. These GTC shall also apply to all future transactions with the purchaser, provided that these are legal transactions of a similar nature. Deviating terms and conditions of the customer are not recognized by Z-HK GmbH unless they have been expressly confirmed by Z-HK GmbH.
2. Contract Conclusion
When placing an order in the online shop www.exclusivebottle.ch, a legally binding purchase contract is concluded between the customer and Z-HK GmbH. The offers of Z-HK GmbH in the online shop are non-binding and subject to change. The contract is concluded only upon acceptance by Z-HK GmbH. The acceptance is deemed to be a written order confirmation via e-mail.
3. Orders
3.1 Prices
The prices published by Z-HK GmbH on the internet apply. Price changes are reserved. The statutory value-added tax is shown separately. The shipping costs incurred are listed and charged separately. By submitting the order (by clicking on the button "Place Order"), the customer submits a binding order for the goods listed in the shopping cart.
3.2 Inspection of the Shipment by the Customer
The customer must check the order for completeness and transport damage immediately upon receipt. In the case of obvious transport damage, the customer is obliged to have it confirmed in writing by the transport company or parcel service. In such cases, the damaged package must be returned to the sender's address. Any further complaints must be reported to Z-HK GmbH immediately to ensure efficient handling.
3.3 Withdrawal of the Order
Although there is no statutory right of withdrawal for online orders in Switzerland, Z-HK GmbH grants its customers the possibility to withdraw the order within 14 days in writing (e.g., by letter or e-mail). The withdrawal period begins upon receipt of the goods. To meet the deadline, it is sufficient to send the withdrawal notice on time. The withdrawal notice should be sent to:

Returns from the customer will only be accepted by Z-HK GmbH if the products are returned undamaged, unused, and in the original packaging. In this case, a full refund of the purchase price will be made. The customer bears the cost of returning the goods.
Returns not accepted by Z-HK GmbH will be returned to the customer. If the customer does not pick up the shipment at the post office, a second delivery attempt will be made. If the shipment is not picked up again, it will be returned to Z-HK GmbH. In this case, Z-HK GmbH reserves the right to use the goods for its own purposes without the consent of the customer. In this case, the customer waives any claims for compensation.
4. Payment and Delivery Conditions
All deliveries are made by Swiss Post or another shipping service provider. The handover to the parcel service takes place only after payment has been received. The delivery time is usually 3 - 10 business days after payment is received. The delivery is made to the delivery address provided by the customer. Z-HK GmbH sends the goods in neutral and suitable packaging.
If not all ordered products are in stock, Z-HK GmbH is entitled to make partial deliveries, provided this is reasonable for the customer. In such cases, the additional shipping costs are borne by Z-HK GmbH, provided that the customer is not unreasonably disadvantaged.
Z-HK GmbH generally only delivers within Switzerland and to Liechtenstein. Deliveries to other countries are possible upon request via e-mail to contact [ at ] exclusivebottle.com. Please note that import VAT and import duties may be incurred for deliveries abroad, over which Z-HK GmbH has no control.
Important Note: If the customer intentionally selects "Switzerland" or "Liechtenstein" as the delivery country during the order process, although the actual delivery address is abroad, Z-HK GmbH reserves the right to refund only 50% of the purchase price and retain 50% of the purchase price as a processing fee.
Z-HK GmbH accepts payments by advance payment, credit card (Visa, MasterCard, American Express), cash on delivery, direct debit, or by using e-payment services (e.g., PayPal or TWINT). The credit card will be charged immediately after the order is placed. For retailers, Z-HK GmbH issues an invoice for orders of 500 CHF or more, which must be paid within 30 days. In such cases, delivery is free domicile.
4.1 Due Date and Reminder Fees
All orders must be paid immediately after booking or upon receipt of the invoice. If the payment deadlines are not met, a reminder fee of 20 CHF per reminder will be charged.
5. Retention of Title
The goods remain the property of Z-HK GmbH until full payment has been made.
6. Liability and Warranty
6.1 Disclaimer of Liability
Z-HK GmbH excludes any liability for damages that are not based on intentional or grossly negligent breach of duty. This does not apply to damages resulting from injury to life, body, or health or in the case of claims under the Product Liability Act. The same applies to breaches of duty by vicarious agents of Z-HK GmbH. The statutory rights of the customer in the event of defects remain unaffected.
6.2 Transmission Errors
Z-HK GmbH accepts no liability for transmission errors, regardless of whether the cause lies with the customer, Z-HK GmbH, or a third party.
6.3 Youth Protection
The sale of alcoholic beverages to minors is prohibited by law. The offer is therefore aimed exclusively at persons who are at least 18 years old. By confirming the GTC, the customer expressly declares that he/she has reached the age of 18.
7. Data Protection
The processing of personal data is carried out in accordance with Swiss data protection legislation. Data will not be passed on to third parties unless this is necessary for contract fulfillment (e.g., shipping by partner companies) or due to legal requirements. The customer has the right to free information as well as correction, blocking, or deletion of his/her data.
8. Applicable Law and Jurisdiction
Only Swiss law applies. The place of jurisdiction for all disputes is 8712 Stäfa ZH. Mandatory jurisdiction provisions at the customer's place of residence remain unaffected.
